Regular readers will know that as a lawyer here in Spain I have been doing property purchases for more than 30 years, in addition to my role as Consul for Denmark. One of the rules which I have adhered to from the outset is don’t assume anything when you purchase a property here in Spain.
In any given week my team of lawyers carry out a number of property transactions for clients all over the world. In this particular case as with all the others the client was interested in buying a property and the agent had sent to us all the documents relating to it. On the face of the documents all was well and there was no cause for alarm.
However, I of course checked all the documents and discovered that there was an embargo on the property, which had not been disclosed by the estate agent and was not referred to in any of the papers. The client of course was duly advised and the matter was dealt with. This is by no means a common occurrence but it pays to have the lawyer take the time to verify everything, and to take nothing for granted. Of course never pay or sign anything until you have been advised to do so by your own independent lawyer.
