A huge number of UK citizens are now thinking of moving to Spain, now that the UK government has placed Spain on the amber list. This means that as a UK citizen you can visit Spain but you have to self-quarantine on your return to the United Kingdom. Of course, for people making the move to Spain, this isn’t a problem as they do not intend to come back to the UK in the near future.
However, if you’re planning to move to Spain to live on a permanent basis there is one thing that you will need to do before you leave the United Kingdom, and that is to apply for residency or residencia as it is called here in Spain. You can’t come to Spain and then apply for residency. At Just Law Solicitors here in Spain we have a 100% success rate in residency applications, which means that we will not waste your time and money by making applications that will ultimately prove to be unsuccessful.
If you were, and then Spanish government uses the word ‘staying’ in Spain before the end of 2020, i.e. before the end of the post brexit transition period then you can make the application when you come to Spain.
In any event we have 30 years of legal experience and if you contact us before you leave the UK we can advise you accordingly.
If you’re just buying a holiday home here in Spain then nothing has changed, you can still legally buy a house or apartment in Spain but you will be limited to 90 days in a 180 day period. Remember if you plan to stay more than 183 days in a calendar year in Spain you will have to pay tax in Spain, this is called ‘declaration de la renta’. A number of clients prefer to see what their tax liabilities are here in Spain before they make the move. At Just Law Solicitors in addition to offices in Malaga, Fuengirola and Marbella on the Costa Del Sol we can offer an online conference with our registered tax advisor Pablo. Pablo has 10 years of tax experience here in Spain and has worked for Price Waterhouse Coopers.
You can purchase a property sight unseen from the UK but we do not advise it. If you know to have an independent lawyer here in Spain for your property purchase send us an email for a no-obligation quote, once you have agreed on the price with the Spanish Estate Agent or the private seller, don’t sign or pay anything until you have taken some advice from your own independent Solicitor here in Spain.
So post brexit it is a little more difficult moving to Spain, but we can help you make the move.
