Our senior Lawyer and Consul for Denmark Marisa Moreno Castillo was invited to speak at the post-Brexit conference at Palacio De Congresos in Marbella. Marisa was one of 4 panelists lecturing on the legal aspects of the post-Brexit situation in Spain for citizens of the United Kingdom.
The lecture included aspects such as family law and company law and jurisdiction issues in case of trans-border conflicts. Also how inheritance and wills have been affected by Brexit. In addition the consequences of the ending of free movement of UK citizens in Spain, and the different visa options for UK citizens looking to move or visit Spain. It was made clear that buying a property in Spain has not changed. So if you plan only to spend 90 days in a 180 day period in Spain you are able to move to Spain or retire to Spain without any issues.
Note that if you plan to relocate to Spain on a permanent basis, you will need to make an application for residency or residencia as it is called here in Spain. If you plan on spending more than 183 days in Spain in a calendar year you will have to pay Spanish tax. At Just Law Solicitors here in Spain one of our lawyers is a registered tax specialist.
If you purchase a property for more than 500,000 euros you are able to apply for the Golden Visa. If you plan to buy a property in Spain do not sign or pay anything until you have taken some independent legal advice from a Spanish Lawyer.
