Is there really the possibility of obtaining Spanish nationality through grandparents in 2022?
With the UK leaving the EU post-Brexit, this question gets asked by UK citizens, citizens of the USA, Canada, and other non-EU citizens.
The first thing we must clarify is that the simple fact of being the grandchild of a Spanish person is not enough to obtain Spanish nationality. But, it could be an advantage when you request it.
The Spanish law states that, in general terms, to acquire Spanish nationality by residence, you must reside in Spain for 10 years. This period can be reduced in some cases when the applicant was born outside of Spain to a father or mother, grandfather or grandmother, who were originally Spanish. This is from parents or grandparents born in Spain or who had Spanish nationality since birth. In this case, they only have to live legally in Spain for 1 year.
What applies is a nationality by residence, with a notable reduction in the term for being the son or grandson of a Spaniard from birth (within or outside of Spain)
However, this will not allow someone to obtain nationality immediately, it will only allow the applicant to benefit from the reduction of the term of residence from 10 years to 1 year.
So basically if youâre from say the United Kingdom or any other non-EU country you will have to come here on for example the Non-Lucrative Visa âNLVâ for a year.
